Welcome to Lochaven Landscapes. By using our services, website, and related offerings, you agree to abide by the following Terms and Conditions. These terms outline the agreement between you (the “Client”) and Lochaven Landscapes (“we,” “us,” “our”). Please read them carefully.

1. General Terms

By engaging our services, you confirm that you are at least 18 years old and legally capable of entering into this agreement.

Our services are provided on a contractual basis and subject to availability.

We reserve the right to refuse service for any reason, including non-compliance with these Terms.

2. Services Provided
Lochaven Landscapes offers a range of garden maintenance and landscaping services, including but not limited to:

Garden maintenance subscriptions (Essential, Premium, and Prestige Plans)
-
One-off landscaping and garden transformation services
-
Custom garden design and consultancy
Each service is subject to an agreed-upon scope, schedule, and pricing, detailed in our service agreements or invoices.

3. Garden Maintenance Subscriptions
3.1 Subscription Plans

Clients may choose from our Essential, Premium, or Prestige subscription plans.

A initial setup fee is required to begin any subscription. This fee covers initial assessments and garden preparation and is non-refundable.
3.2 Payment & Billing

Subscriptions are billed monthly in advance.

Payments must be made via accepted payment methods as outlined on our website or invoices.

Failure to make payment by the due date may result in service suspension or cancellation.
3.3 Cancellations & Refunds

Clients may cancel their subscription at any time with 30 days’ written notice.

No refunds will be issued for unused portions of a prepaid service period.

If we are unable to fulfill scheduled services, we will offer a rescheduled appointment or a service credit.

4. One-Off Landscaping & Custom Services
4.1 Project Pricing & Payment

Landscaping projects are invoiced progressively as the job progresses.

A deposit may be required before work begins, with additional payments due at project milestones.

Full payment is required upon project completion.
4.2 Cancellations & Refunds

If a project is canceled before work begins, a full refund may be issued, minus any costs incurred for materials or preparation.

Once a project has started, no refunds will be issued for completed work.

If Lochaven Landscapes cancels a project due to unforeseen circumstances, we will issue a partial refund based on the percentage of work completed.

5. Client Responsibilities

Clients must provide accurate property details and service requirements.

Clear access to the property must be provided for scheduled maintenance visits.

Clients are responsible for securing pets and removing obstacles that may hinder service.

Any damage caused by pre-existing property conditions (e.g., unstable fencing, broken irrigation systems) is not our liability.

6. Weather & Service Disruptions

Services may be delayed or rescheduled due to extreme weather, safety concerns, or unforeseen circumstances.

We will make reasonable efforts to reschedule affected appointments.

No refunds will be issued for missed visits due to weather, but service credits may be provided if rescheduling is not possible.

7. Liability & Warranties

We take reasonable care in performing services, but we are not liable for damage resulting from existing landscape conditions, underground utilities, or unforeseen factors.

Any complaints or issues must be reported within 48 hours of service completion for resolution.

We do not guarantee plant survival or garden growth outcomes, as they depend on factors beyond our control (e.g., soil conditions, watering, climate).

8. Payments & Late Fees

Invoices must be paid within the timeframe specified (typically 7 days from the invoice date).

Late payments may be subject to a 5% late fee per month.

Non-payment beyond 30 days may result in service suspension and referral to a collection agency.

9. Modifications & Updates

We reserve the right to update these Terms & Conditions at any time. Clients will be notified of significant changes via email or website updates.

Continued use of our services after updates constitutes acceptance of the revised terms.

10. Governing Law & Disputes

These Terms & Conditions are governed by the laws of Victoria, Australia.

Any disputes shall first be addressed through negotiation. If unresolved, they will be handled through mediation or legal proceedings.
